Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of FloEngine's website, CRM, and booking platform (together, the "Service"), provided by FloEngine ("FloEngine," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account.
2. The Service
FloEngine provides tools to manage leads, contacts, deals, and bookings, including the ability to connect a Facebook Page so that leads submitted through Facebook and Instagram Lead Ads are added to your account automatically. We may add, change, or remove features of the Service at any time, and we will try to give reasonable notice of material changes.
3. Free Trial, Fees, and Billing
New accounts include a 60-day free trial. A valid payment method is required to start the trial, but you will not be charged until the trial period ends.
Unless you cancel before your trial ends, you authorize us to automatically charge the card on file for the plan you selected at signup, on a recurring basis, until you cancel.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period, and fees already paid are non-refundable except where required by law.
We may change our prices with advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
4. Your Data and Content
You retain ownership of the leads, contacts, and other data you submit to or collect through the Service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and support the Service. You are responsible for having the necessary rights and permissions to submit Customer Data, including data received through your connected Facebook Page, and for complying with applicable data protection and marketing laws when contacting your leads.
5. Third-Party Integrations
The Service may integrate with third-party platforms, including Meta (Facebook and Instagram). Your use of those integrations is also subject to the third party's own terms and policies. We are not responsible for the availability, accuracy, or practices of third-party platforms, and we may suspend an integration if a third party changes or restricts its API.
6. Acceptable Use
You agree not to: use the Service for any unlawful purpose or to send spam or unsolicited communications; upload data you do not have the right to use; attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service; or resell or provide the Service to third parties without our written consent.
7. Intellectual Property
The Service, including its software, design, and branding, is owned by FloEngine and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features except as necessary to use the Service as intended.
8. Termination
You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if we discontinue the Service, with notice where reasonably possible. Upon termination, your right to use the Service ends, though certain provisions of these Terms will continue to apply.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that leads captured through third-party integrations will always sync correctly.
10. Limitation of Liability
To the maximum extent permitted by law, FloEngine will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.
11. Indemnification
You agree to indemnify and hold FloEngine harmless from any claims, damages, or expenses arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the effective date above and, where appropriate, through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which FloEngine is established, without regard to conflict-of-law principles, unless otherwise required by applicable law.
